This indenture, made and concluded this 3rd day of September 1844, between Mary C. Cook, John Cook and Phebe, his wife, Jacob Cook, and Catherine, his wife, and Henry Cook, of the county of Jefferson and Commonwealth of Virginia, on the one part, and William Flanegan, of the county and state aforesaid, on the other part, Witnesseth, that the said parties of the first part, for and in consideration of the sum of one hundred and fifty dollars, to them in hand paid by the said William Flanagan, at or before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged, hath granted, bargained, and sold, and by these presents doth grant bargain and sale unto the said William Flannegan, his heirs and assigns forever, all right, title, and claim that the said Mary C Cook, John Cook and Phebe, his wife, Jacob Cook and Catherine, his wife, and Henry Cook, now hath or may hereafter have to a certain lot or parcel of land, lying and being in the county of Jefferson, and state aforesaid, adjoining the lands of Daniel Bailer, Robert Creamer and others, and is bounded as follows. Beginning at a stone about three feet from a black and white oak sapling, and 28 2/10 poles from the original corner, and in the line of Robert Creamer; thence running with Creamer’s line and Border’s line N 55 ½ E 36 3/10 poles to a stone in Border’s line, thence S 21 ½ E 17 7/10 poles to a stone about 15 feet from the original line, and line to William Flannegan, then running parallel with Flannegan’s line S83W 36 3/10 poles to the beginning, containing two acres. Together with all and singular, the rights, improvements, hereditaments, and appurtenances whatsoever thereunto belonging, or any way appertaining. To have and to hold the said lot of land, with all and singular and the premises and appurtenances hereby granted unto the said William Flannegan, his heirs or assigns, to the only proper use and behoof of him the said William Flannegan, his heirs and assigns forever; and the said Mary C. Cook, John Cook, Phebe, his wife, Jacob Cook, and Catherine, his wife, and Henry Cook doth covenant to and with the said William Flannegan; now at the time of sealing and delivery of these presents, are seized of a good, sure, perfect, and imde[?] estate of inheritance in fee simple of and in the premises hereby granted, and that they have full power and absolute authority to grant and convey the same to the said William Flannegan, his heirs and assigns, in manner and favor aforesaid. And lastly, that the said Mary C. Cook, John Cook, and Phebe, his wife, Jacob Cook, and Catherine, his wife, and Henry Cook and their heirs, all and singular the premises hereby granted and released with appurtenances unto the said William Flannegan, his heirs or assigns, against them the said Mary C. Cook, John Cook and Phebe, his wife, Jacob Cook and Catherine, his wife, and Henry Cook, and their heirs and all and every person or persons whatsoever shall warrant and forever defend by these presents. In Witness whereof, the said Mary C. Cook, John Cook and Phebe, his wife, Jacob Cook and Catherine, his wife, and Henry Cook, hath hereunto set their hands and seals the day and year above written.
