To Deed of Bargain and sale
The Cherry Run and potomac valley Railroad Company
THIS DEED, made this 11th. day of April 1903, by and between John G. Flanagan and Bertha S. Flanagan his wife the first parties and The Cherry Run and Potomac Valley Railroad Company the second party,
WITNESSETH: That in consideration of the sum of five thousand five hundred dollars, the receipt of which is hereby acknowledged, the said John G. Flanagan and Bertha S. Flanagan his wife do hereby grant and convey unto the Cherry Run and Potomac Valley Railroad Company its successors and assigns, all those two parcels of land situate in Jefferson County, West Virginia, and described as follows:
FIRST: Beginning on the dividing line between the land of the first parties, and the land of Ella G. Lamar, at the intersection of the centre line of said railroad as now located, and running thence on said dividing line north 89 deg. 50 min. east 86.16 feet; thence in a southerly direction by a line curving to the left with a radius of 1347.69 feet parallel to and 85 feet distant from said centre line 558.59 feet; thence south 64 deg. 21 min. west 10 feet; west 10 feet; thence south 25 deg. 39 min. east by a line parallel to and 75 feet distant from said centre line 1310.4 feet to the quarry lot of Flanagan heirs; thence binding thereon south 19 deg. west 182.3 feet south 68 deg. east 174.1 feet north 58 deg. east 75.9 feet south 61 deg. 30 min. east 109.2 feet south 40 deg. 30 min. east 188.9 feet; thence south 25 deg. 33 min. east 36.3 feet south 64 deg. 21 min. west 175 feet thence south 25 deg. 39 min. east by a line parallel to and 75 feet distant from said centre line 569.6 feet; thence in a southerly direction by a line curving to the right with a radius of 2939.93 feet parallel to and 75 feet distant from said center line 565.81 feet to the dividing line between the land of the first parties and the land of A. B. Moler; thence on said dividing line south 89 deg. 25 min west 155.10 feet; thence in a northerly direction by a line curving to the left with a radius of 2789.93 feet parallel to and 75 feet distant from said centre line 498.5 feet; thence north 25 deg. 39 min. west by a line parallel to and 75 feet distant from said centre line 509.6 feet; thence south 64 deg. 21 min. west 71 feet; thence north 71 deg. west 220.4 feet; thence north 26 deg. 45 min. east 167.5 feet; thence north 4 deg. 20 min. east 117 feet; thence north 25 deg. 39 min. west by a line parallel to and 120 feet distant from said centre line 719.7 feet; thence north 75 deg. 22 min. east 91.7 feet;thence north 25 deg. 39 min. west by a line parallel to and 50 feet distant from said centre line 905.92 feet; thence south 64 deg. 21 min. west 35 feet; thence in a northerly direction by a line curving to the right with a radius of 1517.69 feet parallel to and 85 feet distant from said centre line 623.32 feet to the dividing line between the land of the first parties and the land of said Lamar and thence binding on said dividing line to the place of beginning.
Containing 14.41 acres
SECOND. Beginning on the dividing line between the land of the first parties and the land of Jacob S. Moler at the intersection of the centre line of said railroad as now located and thence binding on said dividing line south 68 deg. 53 min. east 79.07 feet; thence in a southerly direction by a line curving to the right with a radius of 5804.65 feet parallel to and 75 feet distant from said centre line 951.47 feet; thence south 11 deg. 56 min. west by a line parallel to and 75 feet distant from said centre line 56.83 feet to the public road; thence binding on the public road north 68 deg. 17 min. west 18[?].2 feet; thence north 11 deg. 86 min east by a line parallel to and 75 feet distant from said centre line; thence in a northerly direction by a line curving to the left with a radius of 5654.65 feet parallel to and 75 feet distant from said centre line 977.35 feet to the dividing line between the land of the first parties and the land of said Moler and thence on said dividing line 79.13 feet to the place of beginning.
Containing 3.47 acres
Plats are hereto attached upon which the lands hereby conveyed are shown enclosed in yellow lines and said centre line is shown in red.
Said railroad company agrees to build fences on both sides of the two parcels of and hereby conveyed. The first parties agree that they shall not be entitled to a road crossing of any kind over either of the said parcels of land hereby conveyed. The first parties agree to assume all damages to their tenants, and if the crop now growing on the land hereby conveyed is destroyed then the first parties shall be entitled to an additional sum of twenty dollars.
Together with all the improvements thereon, and the rights and appurtenances thereto belonging To have and to hold the said parcel of land unto The Cherry Run and Potomac Valley railroad Company, its successors and assigns, in fee simple.
And the grantors covenant that they will warrant generally, the property hereby conveyed, and that they will grant such further assurance as may be requsite.
And the grantors do hereby release The Cherry Run and Potomac Valley Railroad Company, its successors and assigns, from all damages which may be caused by the location of a railroad through and over the land hereby conveyed, and the residue of said land so far as the location of said railroad effects the same.
