July 2, 2025To the Hon. E. B. Hall Judge of the Jefferson Circuit Court
Humbly complaining shew unto your Honor your Orators Cora V. Daniels, John W. Daniels and Martha Daniels infants under the age of twenty one years by Dennis M. Daniels their father and next friend: That William Flanagan their maternal grandfather departed this life in the year 1853, the owner of and seized of a considerable loaded estate in the County of Jefferson and State of West Virginia. That at the time of his death he left a widow Martha Flanagan and her children James Flanagan and a daughter Ann Rebecca Flanagan, who intermarried with their father Dennis M. Daniels. Their mother, Ann Rebecca Daniels is now deceased, as is also James Flanagan, on the day of 1870. Orators further state that dower estate as aforesaid assigned to the said Martha Flanagan consisted of the hundred and twenty four acres of land in said County of Jefferson adjacent to the Potomac river and adjoining the lands of Samuel Knott, the heirs of Daniel Border and the heirs of I. Clymer. That the son of the intestate William Flanagan at the time of his demise left a widow Frances M. Flanagan, and the following named children: William M. Flanagan, James S., John G., Laura F. who intermarried with George F. Moler, and Mary C. Flanagan who intermarried with John Licklider, who are a [?], and Alice L. and Charles F. Flanagan, infants of whom Robert N Duke is the guardian. That shortly after the death of the intestate William Flanagan in the year 1856 a bill was filed and a decree was had and ordered on the Equity side of the Jefferson Circuit Court to partition the realty of the said William Flanagan between the mother of your orators, and the said James Flanagan, and for the allotment of dower therein to the widow of the intestate, Martha Flanagan, their mother. That said petition was has been made in accordance with law decree as made by the allotment of Dower to Martha Flanagan, was regularly and duly made and confirmed and approved by the Court. That the widow of the intestate Martha Flanagan interest upon the property in of her dower estate so assigned to her, and had and enjoyed the dower to the time of her decease which occurred which orators therein pray that Frances M. Flanagan, the widow of James Flanagan, and the surviving children of the said James Flanagan, William Mc Flanagan, James S., John G. Flanagan, Laura F Moler and George W. Moler her husband, Mary C. Licklider and John Licklider her husband, and Alice L. Flanagan and F. Flanagan and Robert N Duke their guardian may be made parties defendants to this Bill, that a petition may be had, and made between your orators and the said defendants in the dower estate of the said Martha Flanagan, herein before mentioned and described, and that your orators may all others, and proper relief in the M[?], and that the Commonwealths subpoena may be revealed to them.
