Deed of Trust: Caton, Sherman Trustee

This deed made on the 25th day of December, in the year 1865, between George Caton of the County of Jefferson and State of West Virginia, of the one part, and Oliver H. F. Sherman, of the same county and Stae of the other part, witnesseth; that the said George Caton doth grant unto the said Oliver H. F. Sherman the following goods and chattels of the said George Caton, to wit, all the interest of the said George Caton in the twenty acres of growing wheat he has on the farm belonging to the heirs of Jacob Staley deceased, situate about two miles east of Shepherdstown, two bay mares, one cow, two calves, five goats, and one two-horse wagon, one var share plow, one double shovel plow, one single shovel plow, two stands of bees, and all his household and kitchen furniture. All the above named goods and chattels being the county and State aforesaid, in trust, to secure the payment of a debt of one hundred and thirty one dollars and twenty five cents due on the 29th day of July 1865, from William Hunter, of the county and State aforesaid to the said Oliver H. F. Sherman, the payment of which debt was subsequntly undertaken by the said George Caton and the said underaking to pay said debt to the said Oliver H. F. Sherman together with legal interest on the same, is hereby acknowledged by the said George Caton, also to secure a certain debt of one hundred and twenty dollars and fifty-cents on account which is hereby acknowledged to be due and owng from the said George Caton to the said Oliver H. F. Sherman, together with legal interest on the same.

Now if the said George Caton shall well and truly pay the above named sum of money together with the interest thereon to the said Oliver H. F. Sherman within two years from the date of this instrument, then this deed shall be void otherwise it shall remain in full force and effect.
