Chancery – Creditors Bill
Bill, 2 Spa, Letter, Affid, Publication, Proceedings, 2 Decrees, 2 Ans, Bond, 4 C[?] notes.
Possession of the personal property of said Brien, in the County of Jefferson mentioned in the answer of the Deft Dunn and sell the same at public auction, for cash and pay over the same to the Pltff in part satisfaction of this decree. But the Pltffs is not to have the benefit of this decree until they shall have filed in the Clerk’s Office of the Court a land with sufficient security, in a penalty equal to double the money decreed to be paid to them with such condition as the law recognizes in the case of about defendants. And on motion of the deffs. it is ordered that John H. McEndres, Wm. Flanagan, George Reynolds & John Hoffman, or any three of them, but first sworn, do value the lot of Land of said Brien in the County of Jefferson and also inquire whether the defendant Brien hath any personal estate funds within the power of this Court out of which the debt to the Pltff or any part thereof, can be discharged, and report their findings to the Court, And the Pltffs have to amend their bill and to make Richard Ponaw, and Wm. Flanagan residents of Va. Defendants not to allot any funds of deft. Brein in which may be in their hands
