The United States of America, Plaintiff
against
Thomas Kirwan, Defendant.
In Ejectment for a certain lot or parcel of land containing by estimation Thirteen acres of land situated in the County of Jefferson.
The Plaintiffs having filed their Declaration together with a note thereunder written, and it appearing that the Defendant hath been duly served with a copy of the same, and he not appearing: It is ordered that unless the said Defendant appear here and plead at the next Rules, his default will be entered and judgement given against him accordingly. Circuit Court of Jefferson County Va To Wit:
Thomas Kirwan was summoned to answer the United States of America in a plea of ejectment and therefore the said United States of America complains that on the 2nd day of February in the year 1855 the said United States of America was possessed for certain purposes of a certain lot or parcel of land containing by estimation thirteen acres of land, situated in said County of Jefferson between the Shenandoah river and the Loudoun County line, on the crest of the blue ridge Mountain, near Harpers Ferry and on which the said Thomas Kirwan now resides and as to which the said United States of America claims the perpetual use and enjoyment of the trees, timber, woods, and underwoods, of every sort of denomination, and the absolute exclusive and perpetual vesture of the same, being or to be, growing or to grow, planted or to be planted, with the right to encolose, keep and preserve the said with other rights specified in a certain deed from Ferdinand Fairfax and others to John Armstrong, late Secretary of War, dated August 26th 1813, and recorded in the County Court of Jefferson Deed Book No 8 page 63 and being so possessed that the said Thomas Kirwan aforesaid, to wit, on the 3rd day of February in the year 1855 aforesaid entered into said premises, and with holds from the said plaintiff, the possession and use thereof. To the damage of the said plaintiff in the sum of one hundred dollars. And therefore suit is brought.
