These causes came on this 13th day of March 1882, to be heard together upon the papers formerly read and the report of Isaac Fouke Special Commissioner, filed on the __ day of February 1882, and was argued by counsel; and it appearing that a sale of the real estate of which Bernard McCabe died seized, will be necessary to pay the debts audited against his estate as ascertained and confirmed in these causes, the Court doth adjudge, order and decree that unless within sixty days from the rising of this Court the administratrix or heirs of Bernard McCabe, or someone for them, do pay off and discharge thee debts, Isaac Fouke, Wm. L. Wilson and Daniel B. Lucas, any one of whom may act, are hereby appointed Special Commissioners with instructions to sell at public auction before the Post Office in Harpers Ferry the real estate of which Bernard McCabe died seized, as the same is ascertained and reported in the cause of Bridget Boerley against Bernard McCabe’s Admx and heirs, other than the portion heretofore assigned on dower to the widow of said Bernard McCabe, but to prelude the reversion of said dower. Such sale shall be after three weeks advertisement in some newspaper published in Jefferson County or by printed posters as the Special Commissioners deem most expedient, and upon the terms of one third cash, balance in two equal payments in six and twelve months from day of sale, with interest from said day, the deferred payments to be evidenced by bonds of the purchaser and title of the property to be reserved as security for the same. The Special Commissioners or the one acting shall not receive any money under this decree until they or he shall have given bond, with good security before the Clerk of this Court, in the penalty of $500.00 conditioned according to law.
