On again to be heard this 1st day of June 1st 1855; upon the papers formerly had, and upon the further special report of Andrew Hunter made to the present Term as to the purchase of Thomas Burley (or Boerley) and was argued by counsel — upon consideration whereof, the Court doth adjudge, order and decree, that unless the said Boerley shall pay the whole balance due on his purchase as reported, within sixty days from the rising of the Court, then that said special commissioner shall proceed to resell, the said two lots purchased by said Boerley in the same manner and upon the same Terms as heretofore directed in the original decree of sale.– Said resale to be made at the risk of said Boerley– but said resale shall not be made until this decree shall have been served upon said Boerley at least sixty days before the day of sale. And this cause being further heard upon the report of James W. Campbell, as to the disposal of the leasehold property, in the proceedings mentioned– it is further ordered that he continue his effort to carry out the decree heretofore made on that subject– either by a public or private sale, upon the most advantageous terms practicable, and report his proceedings to this Court.
