May 15, 2026This Indenture, made this 19th day of March 1842, between James Caton of the county of Jefferson of the one part, and Sebastian Eaty, Sheriff of said county of the other part. Whereas the said James Caton has been committed to the jail of the said county, charged in execution by virtue of three units of capias and satisfacaciendum, forced from the Clerks office of the county Court of Jefferson County, one in the name of George Koonce (for the use of I. Fouke, trustee) for the sum of two dollars and forty five cents, with int. from May 26, 1838 till paid and one dollar and thirty four cents costs said acct, dated February 5, 1842, one in the name of R. Richardson for the sum of five dollars and 18 3/4 cts costs, with int from March 1, 1841 and one dollar and thirty four cents costs, said acc’t dated Feb’y 8, 1842, and the other in the name of Thomas J. Dodd, for the sum of four dollars and fifteen cents, with int from June 7, 1841, till paid and one dollar fifty five cents costs, and the said James Caton being insolvent, and desirous to be retrieved from his imprisonment, has, by virtue of warrant filed and issued for that purpose, been brought before a justice of the peace for the said county of Jefferson, at the Court house thereof, on this day, and has subscribed and delivered in a schedule of his estate, which schedule contains the following interest in real estate in said county, viz: a life estate on tenancy by courtesy of an undivided fourth part of a certain house and lot in Shepherdstown, which descended from John Lindsay to his heirs at law, one of whom, viz, Ann O., married the said James Caton. Now therefore this Indenture witnesseth, that the said James Caton, pursuant to the act of assembly, in such case made and provided, and for the consideration of the sum of one dollar, to him in hand paid by the said Sebastian Eaty, before the sealing and delivery of these presents, receipt whereof is hereby acknowledged, has granted, baragained and sold, and by these presents doth grant, bargain, sell and convey unto the said Sebastian Eaty, Sheriff as aforesaid, all the real estate hereinbefore mentioned and described, to be by him disposed of according to law. In witness whereof the said James Caton has hereunto set his hand and affixed his seal on the day and year first above written.
