May 15, 2026This Indenture made the 28th day of June 1858, Between George W. Caton of the first part, Benjamin Huffman of the second part, and Robert A. Lucas, John Reynolds, and Albert Humerickhouse of the third part. Whereas the said Caton is indebted to the said Lucas in the sum of $31.50 by his single bill dated the 26 of March 1857, and the sum of $27.61 by his single bill dated the 28th of June 1858, and to the said Reynolds in the sum of $58.25 by his single bill dated the 1st of January 1857, subject to a credit of $4.50 of date the 28th of June 1858 and to the said Humerickhouse in the sum of $27.62 1/2 by note dated the 1 January 1858, and being wiling to secure the payments of the said debts has agreed to give this Deed of trust.
Now this Indenture witnesseth that the said George W. Caton for and in consideration of the premises and of the sum of one dollar paid cash in hand paid by the said Benjamin Huffman on and before the sealing and delivery of this deed, the receipt whereof is hereby acknowledged, hath granted, bargained and sold, and doth by these presents grant, bargain, and sell unto the said Huffman the following property to wit: the said Catons shared fifty acres of wheat growing on the land of Samuel Knott in Jefferson County, 1 horse, 2 Mulls, 1 cow, 21 hogs and pigs, 1 wagon and harness, 1 wagon ladder, 1 cart, and his household and kitchen furniture. To have and to hold the same unto the said Huffman and his heirs forever.
In Trust, for the following interest and purposes, that is to say that the said Huffman shall as soon as may be, have the said whereas gathered, and converted into money on the best terms he can, and apply the proceeds, first to all necessary expenses attending the execution of this trust, next to the payment of the debt aforesaid, prorated, and all interest due thereon, and the residue if any there be, payed to the said Caton, and if the said Caton should fail to pay all the debts aforesaid within six months from this date, then the sum of the Creditors, aforesaid, the said Huffman shall sell the other property or so much thereof as may be necessary, for ready money, first advertising th time, place, and terms of teh sale for two weeks in some newspaper printed in Jefferson County, and apply the proceeds as aforesaid. In Testimony whereof the said George W. Caton hath hereunto set his hand and seal on the day and year first herein written.
