May 15, 2026Deed of Trust.
This Deed, made this 19th day of June in the year 1894, between Patrick O’Brien party of the first part, and George W. Dixon, Trustee, party of the second part, Witnesseth, That the said party of the first part doth hereby grant and convey, with general warranty, unto the said George W. Dixon Trustee, the following described property in the County of Jefferson and State of West Virginia, to wit: the tenants’ share, one half, of about 40 acres of growing wheat, 3/5 share of a 20 acre field of growing corn and 2/5 share of another 20 acre field of growing corn, all of said crops being now in a growing state on the farm of James M. O’Brien, near Halltown in said county, and occupied by the grantor. In Trust, to secure the payment of Three hundred and twenty five dollars ($325.00) with interest, for money borrowed and now due by the grantor to James M. O’Brien. Upon default being made in the payment of the said debt, or any part thereof as the same may become payable, herein secured according to the tenor and effect thereof, the said Trustee, when required by said party hereby secured, shall make sale of the property herein conveyed, or so much thereof as may be necessary upon the following terms: Cash, at private sale, without publication and the proceeds of such sale shall be first applied to the payment of all costs and charges attending the execution of this trust, including a commission of five per centum to the trustee, and then to the payment of said debt and interest herein secured, or so much thereof as shall then remain unpaid, and teh surplus or residue, if any, shall be paid to the grantor (the said Patrick O’Brien), or his heirs and assigns. And if the said Patrick O’Brien or his heirs and assigns shall truly pay the said debt and interest as in form above recited, and make no default therein, then this deed shall be void, or else remain in full force and virtue.
