May 12, 2026This Indenture made this 10th day of October 1826 Between Conway Sloan of the one part, Randall Brown of the second part, and Robert Fulton of the third part all of the town of Charles Town in the County of Jefferson and State of Virginia. Whereas the said Conway Sloan is justly indebted to the said Robert Fulton in the sum of Thirty five dollars and fifty four and three quarter cents by Note bearing date on the 1st day of October 1826 and payable on demand, as will appear from said Note, and the said Conway Sloan being desirous of securing to said Fulton the payment of said note and interest hath agreed to give this Deed of Trust. Now this Indenture witnesseth that the said Conway Sloan for and in consideration of the promises and for the further consideration of one cent in hand paid by the said Randell Brown the receipt whereof is hereby acknowledged, hath granted bargained and sold and by these presents, doth grant bargain, and sell to the said Randall Brown the following articles of personal property, to wit. Two tables, one bed bolder and two bedsteads, and apothecary bottles, one set apothecary drawers with contents a quantity of medicines, one bureau, one book case with a number of books, one pair of and Irons, ten chairs, one pair copper scales, one glass morter, eleven ointment pots, one fire shovel and tongs, with a few other articles not at present recollected, but upon this special trust and confidence, nevertheless, that is to say if the said Conway Sloan shall at any time make default to pay to the said Robert Fulton the said sum of Thirty two Dollars and fifty four and three quarter cents with interest that shall have accrued thereon, when he shall be required by the said Fulton, then it shall be lawful for the said Randell Brown and express authority is hereby given him, to sell the said property hereby conveyed at public auction to the highest bidder for cash, after having first advertised the same in some convenient newspaper, and after having first paid and discharged to the said Fulton, the said sum of Thirty two Dollars and fifty four and three quarter cents, with the interest that shall have accrued thereon, and the cash and charges incident to the execution of this trust to pay the balance if any to the said Conway Sloan or his legal representatives; and is hereby understood between the parties that the said Conway Sloan, shall have, and remain in quiet and peaceable possession of the property herein conveyed, until default be made in the payment of the said sum of money and interest thereon accrusing.
