Barnett; Debt to Eichelberger

This Indenture made the third day of April in the year of our Lord one thousand Eight Hundred and twenty four, between John Barnett of the county of Jefferson and state of Virginia of the first part, Aquilla Davis of the same county and state of the second part. Witnesseth that whereas George Eichelberger is bound in certain securityships for the said John Barnett, to wit, two notes of hand Given to John Allstadt and Henry Garnhart, amounting in the whole to Fifty Dollars and due about the 1st of December next. And the said Barnett being desirous of indemnifying the said George Eichelberger against any losses in consequences of the above securityships hath agreed to give this Deed of Trust. Now therefore this Indenture witnesseth that the said John Barnett for and in considerations of the premises, and for the further consideration of one cent to him in hand paid by the said Aquilla Davis at or before the sealing and delivery of these presents the receipt whereof is hereby acknowledged hath granted bargained and sold, and by these pesents doth grant, bargain and sell, unto the said Aquilla Davis the following property (to wit) one bay horse, and saddle, to milch cows, two beds and bedding — To the only proper use behosh of them the said Aquilla Davis his heirs and assigns. Upon Special Trust and confidence nevertheless that should the said John Barnett fail to pay the said sum of sixty eight Dollars as above mentioned due to John Allstadt and Henry Garnhart for which the said George Eichelberger is bound as security, that then and in that case it shall be lawful for the said Aquilla Davis and express authority is hereby given him to proceed to sell the said property specified above after duly advertising the time and place of the sale, to the highest bidder for ready money at public auction or so much thereof, as will be sufficient to discharge the above mentioned debt with the Interest which may have accrued thereon. Then in the first place to pay all costs and charges attending the due executions of this Trust the aforementioned debt and Interest and the balance balanced, if any, to the said John Barnett or his Legal representatives, and the said John Barnett on his part hereby covenant that he will pay and discharge the said debt for which George Eichelberger is bound as above mentioned and the said Aquilla Davis on his part covenants that he will faithfully execute. This trust hereby reposed in him.– In witness whereof the said parties have hereunto and seals this day and year first above mentioned.
