May 12, 2026This Indenture made this 27th day of November in the year 1833 between Oliver Sloan of the first part, Thomas Briscoe of the second part, and Robert T. Brown and Robert Y. Jack of the third part, all of the County of Jefferson and State of Virginia. Witnesseth, Whereas the said Robert Y. Jack and Robert T. Brown are securities for the said Oliver Sloan in a note or writing obligatory for the payment of money payable to Nancy Shirley, administratux with teh will annexed of William Shirley declared for the sum of sixty three dollars and fifty cents, due nine months after the date, and bearing date on the 25th October 1833, which said note was executed duly by the said Sloan with the said Jack and Brown securities thereto for the purchase of a sorrell mare about three years old made by the said Sloan at the sale of the personal estate of the said William Shirley, deceased, and whereas it is the wish and desire of the said Oliver Sloan to indemnify, and save harmless the said Jack and Brown against any loss which they may sustain on account of said securityship, and for that purpose hath agreed to execute this deed of Trust: This Indenture Therefore Witnesseth, that the said Oliver Sloan, for and in consideration of the premises and for and in consideration of the sum of one dollar in hand paid by the said Thomas Briscoe the receipt whereof is hereby acknowledged, he the said Oliver Sloan hath granted bargained and sold, and by this presents doth grant bargain and sell unto the said Thomas Briscoe his exors admors or assigns the said sorrel mare, purchased as aforesaid at the sale of the personal estate of William Shirley deceased, To Have and to Hold the said sorrel mare unto the said Thomas Briscoe his exors admors or assigns, in trust nevertheless for the following use and purpose– that if the said Oliver Sloan his heirs exors or admors shall well and truly pay of and discharge the said sum of money with all interest which may be due upon the same where the same shall be due and payment demanded, or if suit shall be brought upon the same, shall pay and satisfy the said debt with all interest and costs accruing thereon, then this Indenture and everything herein contained shall be void; But if the said Oliver Sloan, his executors or administrators shall make default and fail to pay the said sum of $63.50 cents, or any part thereof, when the same shall become due, or at any time thereafter when payment thereof shall be demanded with the interest thereon accruing, and the said Robert Y. Jack and Robert T. Brown their or either of their heirs, exors, or admors, shall be held responsible and compelled to pay the same by suit or otherwise, then upon the happening of such default, or upon the institution of such suit, or other inforcement of the payment of said sum of money, it shall be lawful for the said Thomas Briscoe and express authority is hereby given him, upon the request of the said Jack and Brown or either of them, their or either of their exors or administrators, to proceed to sell the said sorrel mare at public auction to the highest bidder for cash, first however giving three weeks notice of the time and place of sale by advertisement in the newspaper printed in Charlestown, and after having first applied the purchase money and paid off and discharged the said sum of $63.50 cents with the interest which shall have accrued thereon, and also all costs of suits, should suit have been brought, and all necessary costs and chargests couregueent on the executing this trust and the sale, shall pay over the remainder if any there be, to the said Oliver Sloan or his legal representative.
